I wish to incite all Christians to rise up and take back the United States of America with all of God's manifold blessings. We want the free allowance of the Bible and prayers allowed again in schools, halls of justice, and all governing bodies. We don't seek a theocracy until Jesus returns to earth because all men are weak and power corrupts the very best of them.
We want to be a kinder and gentler people without slavery or condescension to any.

The world seems to be in a time of discontent among the populace. Christians should not fear. God is Love, shown best through Jesus Christ. God is still in control. All Glory to our Creator and to our God!

Just saw this on KSR. I would imagine UK comes at the Sun-Times with both barrels and makes a major case out of this. It's time to take a stand and demand accountability from irresponsible hacks and media outlets.



I'll also be surprised if the Davis family doesn't pursue this legally as well. It's going to get very interesting very quickly, IMHO.

Sun-Times stands by Kentucky basketball story

According to an attorney representing the University of Kentucky, his letter of complaint to the Sun-Times regarding a story written by Michael O'Brien about potential Wildcats recruit and Perspectives-Calumet player Anthony Davis Jr. that was published, edited and eventually removed from the paper's high school sports Web site Wednesday had not been answered through business hours Thursday.



Early Friday morning, the Web site published another story by O'Brien that stated "sources from three separate universities told the Sun-Times that Davis Sr. asked for money in return for his son's commitment, with the amount ranging from $125,000 to $150,000."



Attorney Stephen L. Barker told the Tribune on Thursday that while the school was glad the original story was off of the paper's site, "taking the story down doesn't cure all the problems. I believe this was beyond irresponsible journalism."



O'Brien's original story centered on Davis' college choice, cited a "reliable source" and said "rumors/sources that have Davis choosing Kentucky are also alleging that the commitment cost $200,000."



Any such payment would be a violation of NCAA rules and, if true, would put Kentucky and Davis' college basketball future into question.

Kentucky makes stands against published rumors

It is not common in the sporting world for athletic teams or their representatives to formally threaten legal action against media personnel or their outlets.



It also is not common, though, for newspapers to publish articles in which "rumors/sources" is a term used to support an allegation as consequential as the one in Wednesday's Chicago Sun-Times story.





There have been a lot of famous names involved in Kentucky basketball through the history of the game, and Stephen L. Barker isn't one of them. The Wildcats trusted him, though, to take an extremely important shot late Wednesday evening.



Barker, a Lexington-based attorney, sent a letter to Michael O'Brien of the Sun-Times demanding the newspaper "withdraw the publication from any source"—an article that connected UK with the payment of $200,000 for a recruit's commitment.



Kentucky and coach John Calipari figured they had enough of this sort of treatment from particular members of the sporting media and decided fighting back was a prudent course.



When the Sun-Times article appeared via a link Thursday afternoon on Twitter, it was the first media report identifying Kentucky as the likely destination for elite basketball prospect Anthony Davis. So naturally it attracted a significant amount of attention.

I wonder how Micheal O'Brien would feel if I wrote an article claiming to have three "reliable" sources stating that he is a child molester? Would he feel a little ill-used? It's awfully easy to put something out there with anonymous sources.

You are correct. There are too many of these writers and bloggers that are hiding behind "reliable sources". It is has just become too easy for anyone to write anything and hide behind that phrase.

P.S. Count me as another who is mystified by all the claims of Cal cheating...have always wanted to ask the haters, "why would he/we when there's no need", as kids are competing for the few available UK spots and Cal likely has to let several off the hook each year.

My only remark; explain to my simple mind why the hottest coach, at the top school in the country, with all the tradition and air time, would even have to consider cheating...

Easily the best writing I've seen from MM.



I think he's right that the Sun-Times might consider it worthwhile to risk an unwinnable lawsuit in exchange for the publicity it would get them, which is just pitiful behavior, but probably true. I wonder, can you get a paper to disclose their sources in a libel trial? If they could, and it led to Pat Forde, it would almost be worth the collateral damage.

The thing about Maggard's piece is that it's really the same animal as the Sun-Times story that everyone's blasting, is it not? He's throwing out accusations and innuendo suggesting that Pat Forde and Rick Pitino are behind this whole plot to force UK to sue to take this issue to trial to make Calipari and William Wesley testify under cross-examination and thereby bring down Calipari and UK. It makes for a good story. It has two villains that are almost universally hated in UK circles. It plays on the UK fan's "it's all a conspiracy against us!" mentality.



While I'd certainly love for Maggard to be right on this and be able to prove it in a public forum to the point that Pitino and Forde are banished from their chosen professions, in the end, there's about as much validity to Maggard's accusations about Pitino/Forde as there are in the Sun-Times story about Davis and Kentucky.

Usually when you hear about reporters going to jail to protect their sources, it's for contempt of court for failure to respond to a grand jury subpoena to divulge sources. I suppose that could happen as well in a civil case if the paper refused to turn over discovery the judge had ordered it to turn over, but since I'm not a civil attorney, I don't know what the odds of that happening would be.



Regardless of any contempt findings, the burden of proof would be on the plaintiff (here, UK and/or the Davis family) to prove that the statements were (a) false and (b) printed with "actual malice," which means either they printed the story knowing it to be false or that they printed it with reckless disregard for the truth. But the thing is, if the plaintiffs make a prima facie case that the story was false (e.g., evidence that Davis was never paid and never asked to be paid), the defendant would have an awfully hard time winning the trial without putting on any evidence as to who its sources were.

Reminds me of Paul Neuman in Absent of Malice... Great film, love seeing

stuff like that.



Really all the paper has to do is say they have had several anonymous sources in the high school community and AAU saying that they heard Davis brag about being able to get $150K if he wanted or that So and So would pay me 6 figures to come to their school, even if he was joking.



Maybe even someone making it up, it's a rumor, nothing will happen to the Sun Times, it will just die...



Thing is DO NOT GO TO THAT GUYS PAGE and give him any hits...



Anytime you take on UK you get a million odd hits from upset fans.



Take one look but just like Tippy Ton...



Let him go the way of the dodo....

The University of Kentucky is dismayed by the continued lack of professionalism and responsible journalism exhibited by Michael O’Brien and the Chicago Sun-Times in running yet another false and defamatory story on August 6, 2010, regarding the University’s recruitment of a high school student-athlete. Both the father of this student-athlete and the University have repeatedly told Mr. O’Brien that these unsubstantiated “rumors” are untrue. Neither the University of Kentucky nor any member of its Athletic Department has offered or paid any money or other illegal benefits to the student-athlete or his family.



Mr. O’Brien’s August 6 story also mischaracterizes the NCAA’s involvement in this matter by stating that “the NCAA is ‘checking’ into the recruitment of” the student-athlete. The University of Kentucky spoke with David Price, NCAA Vice President of Enforcement, who advised that the NCAA contacted Mr. O’Brien simply to inquire as to the alleged sources for his article and that “this in no way confirms an NCAA investigation of the University” or an examination of the recruitment of the named student-athlete. It is the University’s understanding that such an inquiry represents the NCAA’s normal procedure any time allegations of misconduct are made, no matter how outrageous or unsubstantiated they may be.



The University of Kentucky has put Mr. O’Brien and the Chicago Sun-Times on notice that these published statements are false and defamatory. The University fully supports any action the student-athlete and his family may take against Mr. O’Brien and the Chicago Sun-Times. The University is also evaluating all available rights and remedies it may have against Mr. O’Brien and the Chicago Sun-Times in responding to these false and defamatory statements.
